Terms of Service

The short version

Sweatproof is a UK service that helps you get easier lobbies in supported games. It runs through our Discord bot and the machines behind it, and you get access on a subscription, a one-off purchase, or a whitelabel licence.

These terms are the deal between you and us: what you get, what you pay, what we can and cannot promise, and how to stop. They apply the moment you buy, subscribe, link an account, or add our bot to a server.

We have kept the wording as plain as we can without losing anything that matters. Nothing here takes away your statutory rights as a UK consumer.

Words we use

Agreement
means these Terms of Service, together with any schedules, policies, or documents expressly incorporated by reference, as amended from time to time.
Service
means the SweatProof software, Discord bot, subscriptions, whitelabel licences, and all related products and services made available by the Provider.
Customer
means the individual or legal entity that accesses, purchases, subscribes to, or otherwise uses the Service, being the party identified as “you”.
Subscription
means a recurring right to access the Service for a defined billing period, as selected by the Customer at the point of checkout.
Content
means any digital content and/or digitally supplied service provided to the Customer under this Agreement.
Business Day
means any day other than a Saturday, Sunday, or public holiday in England and Wales.

1.Agreement to these terms

These Terms of Service apply to your access to and use of Sweatproof digital products, software, Discord bot features, subscriptions, whitelabel licences, and any related services we provide (the "Service"). Sweatproof is operated in the United Kingdom.

By purchasing, subscribing, joining, logging in, assigning your identification, linking an account, adding our bot to a Discord server, or otherwise using the Service, you confirm that you have read, understood, and agree to these terms. If you do not agree, you must not purchase, access, install, or use the Service.

You must be at least 18 years old (or the age of majority where you live) to purchase or use the Service. These terms, and any dispute arising from them or the Service, are governed by the laws of England and Wales, and you and we submit to the exclusive jurisdiction of the courts of England and Wales. Nothing in these terms affects your non-excludable statutory rights as a consumer.

2.The service & no guarantee of results

Sweatproof provides automated matchmaking assistance for supported games through a Discord bot and connected infrastructure. Access is delivered digitally through Discord. Features, regions, machines, pricing, and availability may change, be limited, or be withdrawn at any time as we develop, maintain, or secure the platform.

The Service assists with matchmaking. We do not guarantee any specific lobby, opponent difficulty, availability, queue time, uptime, win rate, or outcome. Bot availability fluctuates and lobbies are never guaranteed.

You are responsible for having a compatible game account and for complying with the terms of any third-party game or platform you use the Service with. Third-party games and platforms are outside our control and may change, restrict, or remove functionality at any time, which may affect or interrupt the Service without liability to us.

3.Digital product access and statutory cancellation rights

Our products are digital content and/or digitally supplied services. Access may begin immediately after payment, subscription activation, account linking, Discord verification, or identification assignment.

Where you request or agree to immediate supply of the digital product during any cooling-off period, and you acknowledge that your cancellation right will be lost once supply begins, you agree that your statutory cooling-off cancellation right ends when access to the digital product starts.

Nothing in these terms limits your statutory rights under applicable UK consumer law, including rights that may apply if digital content is faulty, not as described, or not supplied with reasonable care where required by law.

This clause concerns your statutory cooling-off right. Cancelling an ongoing subscription is a separate matter and is dealt with in the Cancellation policy clause, which you can use at any time regardless of this clause.

4.Payments and subscriptions

Subscription plans are billed in advance for the period shown at checkout (for example weekly, monthly, every three months, or yearly) and renew automatically at the then-current price until you cancel. Whitelabel licences are billed on their own recurring cycle.

All payments are processed by Stripe and Sweatproof is the merchant of record for every transaction on the platform, including sales made through whitelabel stores. You are responsible for ensuring your billing information is accurate and that you are authorised to use the payment method provided. Prices include applicable UK taxes unless stated otherwise.

We may refuse, cancel, suspend, or reverse a transaction where we reasonably believe there is fraud, abuse, chargeback misuse, unauthorised payment activity, or a breach of these terms.

5.Cancellation policy

You can cancel your subscription at any time, without giving a reason and without contacting us. Go to https://sweatproof.gg/portal, open your subscription, and cancel there. Cancellation takes effect immediately in the sense that no further payments are taken.

Cancelling stops future renewals only. Your access continues until the end of the billing period you have already paid for, and it then ends automatically — cancelling part-way through a period does not shorten or refund that period. You do not need to cancel before the end of a period to avoid being charged twice; cancelling at any point before the renewal date is enough.

You can resubscribe at any time. A new subscription starts a new billing period at the price then advertised, and does not restore any unused time from a previous one.

If you cannot reach the portal, or your cancellation does not appear to have taken effect, contact us immediately using the details in the Contact clause below and we will action it. We will not treat a payment as validly taken where you can show you attempted to cancel before the renewal date and were prevented from doing so.

We may also cancel or decline to renew a subscription ourselves, for example where the Service is withdrawn in your region, where continued supply is not reasonably possible, or as set out in the Suspension, removal, and termination clause. Where we cancel for a reason that is not your breach of these terms, we will refund any period you have paid for but not received.

6.Refund policy

Our products are digital and access begins as soon as your subscription is active. Where you have asked for immediate access and acknowledged that this ends your cooling-off cancellation right, payments for digital products and active subscriptions are non-refundable once access has started, except where the law requires otherwise or where these terms say otherwise.

This does not affect your statutory rights. If the Service is faulty, not as described, or not supplied with reasonable care and skill where the law requires it, you may be entitled to a repeat performance, a price reduction, or a refund under UK consumer law, and nothing in these terms removes that.

We will refund you where we cancel or withdraw the Service for a reason that is not your breach of these terms, for any period you have paid for and not received. Where a fault on our side prevented you from using the Service for a material part of a billing period, we may issue a partial refund or a credit or extension of equivalent value; the Service availability and SLA credit clause sets out how that is handled.

We do not refund for a change of mind after access has started, for periods you chose not to use, for time lost to a third-party game or platform being unavailable or changing how it works, or where access was removed because of a breach of these terms.

Outside the cases above, refunds, credits, or goodwill extensions may be issued at the discretion of Sweatproof leadership or management. Any discretionary refund is a one-off and does not create an obligation to provide a refund in the same or similar circumstances in future.

To request a refund, contact us using the details in the Contact clause below, from the account that made the purchase, including the approximate date of payment and what went wrong. We aim to respond within five Business Days. Approved refunds are returned to the original payment method through Stripe; the time it takes to appear on your statement is set by your bank or card issuer and is outside our control.

If you believe a payment is wrong, please contact us before raising a chargeback. Raising a chargeback instead of contacting us may result in the suspension of access while the dispute is resolved.

7.Free trial

Where we offer a free trial, access is limited to the number of sessions stated at the time of sign-up. Free trial access is provided once per Discord account and is non-transferable. Attempting to create multiple accounts or otherwise obtain more than one trial per person is a breach of these terms and may result in removal of trial access and permanent exclusion from future trials or subscriptions.

Trial sessions do not carry over, cannot be exchanged for subscription time, and expire when the stated session limit is reached. We may withdraw, modify, or end the free trial offer at any time without notice. Abuse of free trials, chargeback fraud, payment fraud, or attempting to evade a suspension or ban may result in immediate termination without refund and, where appropriate, referral to payment providers or authorities.

8.Licence and permitted use

Subject to your continued compliance with these terms and payment of any applicable subscription fees, we grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Service for your own permitted use only.

You must not sell, share, rent, sublicense, resell, transfer, leak, distribute, or provide access to the software, bot, account, licence key, token, subscription, or related materials unless we have given you written permission (for example, through an approved whitelabel arrangement). Your subscription is for your personal use only — sharing your lobby codes or account so that others use the Service without their own active subscription is prohibited.

You are responsible for keeping your account, Discord account, licence details, and authentication information secure. Activity carried out through your account may be treated as your activity.

9.Acceptable use & prohibited conduct

You must not attempt to crack, bypass, disable, tamper with, reverse engineer, decompile, disassemble, copy, modify, exploit, scrape, clone, or interfere with the software, bot, website, licence checks, authentication systems, payment systems, anti-abuse systems, or any related infrastructure.

You must not attempt to gain unauthorised access to accounts, systems, servers, source code, APIs, private channels, payment records, bot commands, logs, or user data; nor use the Service in a way that causes or attempts to cause downtime, degraded performance, spam, abuse, rate-limit bypassing, denial-of-service, security issues, or disruption to other users.

You must not use the Service for anything unlawful, abusive, fraudulent, harassing, or in breach of a third-party platform's rules, or in any way that may harm Sweatproof, our users, our infrastructure, Stripe, Discord, or any third party; and you must not misrepresent the Service to others.

10.Suspension, removal, and termination

We may suspend, restrict, remove, or terminate your access to the whole platform if you breach these terms, misuse the Service, create risk for us or others, fail to pay, abuse support, initiate fraudulent disputes, present a fraud or chargeback risk, or where we reasonably consider removal necessary to protect the Service, our community, or our legal interests. A suspended user is blocked from the platform except to appeal.

Where lawful, we may also refuse service or remove access at our discretion. We will not use this discretion in a way that removes any non-excludable statutory rights you have under UK law.

If your access is removed for breach, abuse, fraud, chargeback misuse, or prohibited conduct, you may lose access to your subscription without refund unless a refund is required by law or expressly approved by management. Provisions that by their nature should survive termination (including liability, indemnity, and governing law) continue to apply.

11.Service availability and SLA credit

We aim to keep the Service available, but we do not guarantee uninterrupted or error-free access. Planned maintenance, emergency maintenance, third-party outages, Discord issues, Stripe issues, hosting issues, user-side setup problems, network issues, and force majeure events may affect availability.

For qualifying Sweatproof-controlled service downtime, you must allow up to 24 hours for investigation, mitigation, and restoration before any service credit applies.

After the first 24 continuous hours of qualifying Sweatproof-controlled downtime, we will add 1 day globally to affected active subscriptions for every additional full hour of qualifying downtime, unless leadership reasonably decides to provide a greater credit.

This SLA credit is the exclusive service credit for downtime and applies only to active subscriptions affected by the qualifying downtime. It does not apply to downtime caused by your own device, internet connection, Discord account, payment status, breach of terms, third-party platforms, or events outside our reasonable control.

12.Updates, changes, and beta features

We may update, patch, modify, suspend, rename, replace, or discontinue parts of the Service to improve performance, security, compliance, or user experience.

Some features may be experimental, limited, or in beta. Beta features may change or be removed without notice and may not work perfectly.

13.Whitelabel resellers — general

A whitelabel licence lets you operate a branded storefront and Discord bot ("your Store") that run on our shared infrastructure and resell the Service to your own customers ("your Customers"). This section applies in addition to the rest of these terms, and because you sell on our behalf you are held to a high standard.

You are an independent operator, not our employee, agent, partner, or joint venturer. You are solely responsible for your Store, your branding, your Customers, your conduct, and your compliance with all applicable laws (including consumer, advertising, tax, and data-protection laws) in every place you sell.

You must accurately describe the Service, must not make guarantees we do not make (including about lobbies, results, uptime, or availability), must not imply endorsement or partnership beyond the licence granted, and must not mislead your Customers about pricing, what they are buying, who provides it, or their rights.

14.Whitelabel — payments, payouts & chargebacks

All payments in every Store are taken by us as merchant of record through Stripe. For each qualifying sale you receive a fixed payout, paid to your connected Stripe account; we retain the remainder. Payout amounts and timing are as shown to you in your dashboard and at onboarding, and may be adjusted for corrections, refunds, chargebacks, and fees.

Stripe is our standard and preferred payout method. If you opt for manual payouts, your earnings accrue as a balance that we settle by hand to a payment method you nominate. We may refuse or deny any type of payment method other than Stripe, at our sole discretion, in which case your balance remains payable via Stripe once connected.

Manual payout balances are settled monthly: payouts are issued on the 15th of each month, and we may take up to 14 days from that date to release a payout. A balance that is under review (for example for suspected fraud, refunds, or chargebacks) may be held over to the next payout date.

You are responsible for any chargeback, dispute, or refund arising from a sale through your Store. The amount refunded or charged back, plus any associated fees, is deducted from your balance. If your balance is insufficient, the shortfall becomes a negative balance that you owe to us and that we may recover by offsetting future payouts, charging your connected account or payment method, or by other lawful means.

We will, where reasonable, contest chargebacks and disputes on your behalf as merchant of record, but we do not guarantee any outcome. You are responsible for your own taxes on your payouts. We may withhold, delay, or reverse payouts where we reasonably suspect fraud, excessive chargebacks, breach of these terms, or a legal or Stripe requirement.

15.Whitelabel — free (earn-out) licences

We may offer a free whitelabel option. It is granted only by application and approval, at our sole discretion, and everything you tell us in your application must be accurate. Misrepresenting your community, your intentions, or your identity in an application is grounds for denial, and for revocation and suspension if discovered later.

A free licence is not free of charge — it is an earn-out. Each month, the standard whitelabel licence fee is recovered from your Store's earnings before anything is paid out to you: your per-sale payouts are retained by us until the full licence fee for that month has been recovered, and only earnings above that amount are paid out or accrued to your balance. This repeats every month for as long as you hold a free licence.

If your Store earns less than the licence fee in a given month, we do not invoice you for the shortfall and the unrecovered portion does not carry over as a debt — but amounts you owe us for refunds, chargebacks, or fees remain payable as set out above and are separate from the earn-out.

A free licence renews monthly at no upfront charge while your approval stands. We may revoke a free licence, decline to renew it, change the earn-out amount, or require you to move to a paid licence at any time on reasonable notice. All other whitelabel terms apply to free licences in full.

16.Whitelabel — your Customers & the underlying service

Your Customers purchase access to the underlying Service. That entitlement is global: a Customer's active subscription works across our platform, not only in your Store's Discord server.

You may enforce your own server's rules within your own Discord (including removing a user from your server), but you must not deny, disable, revoke, or interfere with a Customer's access to the underlying Service while they have paid, unexpired time remaining, and you must not present such an action as coming from Sweatproof.

Only Sweatproof may suspend, ban, or blacklist a user from the underlying Service itself. If you believe a Customer should be removed from the Service (rather than just your server), report it to us and we will decide. You must handle your Customers' data and support fairly and lawfully, and must promptly pass on any legal, refund, or data request that relates to us or the underlying Service.

17.Whitelabel — bot, credentials & conduct

You provide your own Discord bot credentials so your Store can run on our infrastructure. We store your secrets encrypted and use them only to operate your Store. You are responsible for keeping your credentials valid and for your bot's permissions and conduct in your server.

You must not use whitelabel access to compete unfairly with us, to build a competing service, to circumvent our fees or payment processing, to harvest or misuse Customer or platform data, or to bring the Service into disrepute. Breach of this section may result in immediate suspension of your Store and forfeiture of pending payouts to the extent permitted by law.

You indemnify and hold us harmless against any claim, loss, fine, or cost (including reasonable legal costs) arising from your Store, your Customers, your conduct, your representations, or your breach of these terms.

18.Intellectual property

We own the Service, its software, infrastructure, and the Sweatproof brand. A whitelabel licence grants only a limited, revocable, non-exclusive right to operate your branded Store on our infrastructure during the licence term; it transfers no ownership. All rights not expressly granted are reserved.

19.Limitation of liability

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any statutory rights that cannot be excluded under UK law.

To the fullest extent permitted by law, the Service is provided on an as-is and as-available basis. We are not liable for indirect loss, loss of profits, loss of revenue, loss of goodwill, loss of data, business interruption, third-party platform issues, or losses caused by your misuse of the Service.

Subject to the above, our total aggregate liability to you for claims relating to the Service is limited to the greater of £100 or the amount you paid to us in the three months before the claim arose.

20.Privacy & your data

How we collect, use, share, and protect personal data — for subscribers, free-trial users, whitelabel owners, and their customers — is set out in our Privacy Policy. We process personal data in accordance with UK data protection law, including the UK GDPR and the Data Protection Act 2018, and we do not sell your personal data.

21.Changes to these terms

We may update these terms from time to time. The updated version will apply from the date shown on this page or from the date we otherwise notify you. If a change materially affects your rights or obligations, we will take reasonable steps to make the update clear. Continued use of the Service after changes take effect means you accept the updated terms.

Accepting these terms

You accept these terms by using the Service — buying, subscribing, activating, linking an account, adding our bot to a Discord server, or otherwise getting access, whichever happens first. There is nothing to sign. If you do not agree with something here, do not buy or use the Service. These terms and anything arising from them are governed by the laws of England and Wales.
