Terms & Privacy

How Sweatproof subscriptions, digital access, refunds, acceptable use, service credits, and privacy work. Written for UK customers — read before purchasing or using the service.

01. Agreement to these terms

These Terms of Service apply to your access to and use of Sweatproof digital products, software, Discord bot features, subscriptions, licences, and any related services we provide.

By purchasing, subscribing, joining, logging in, assigning your identification, linking an account, or using the service, you confirm that you have read, understood, and agree to these terms.

If you do not agree to these terms, you must not purchase, access, install, or use the service.

02. Digital product access and cancellation rights

Our products are digital content and/or digitally supplied services. Access may begin immediately after payment, subscription activation, account linking, Discord verification, or identification assignment.

Where you request or agree to immediate supply of the digital product during any cooling-off period, and you acknowledge that your cancellation right will be lost once supply begins, you agree that your statutory cooling-off cancellation right ends when access to the digital product starts.

Nothing in these terms limits your statutory rights under applicable UK consumer law, including rights that may apply if digital content is faulty, not as described, or not supplied with reasonable care where required by law.

03. Payments, subscriptions, and refunds

Payments and subscriptions are processed through Stripe or another payment provider we choose. You are responsible for ensuring your billing information is accurate and that you are authorised to use the payment method provided.

Unless required by law, payments for digital products and active subscriptions are non-refundable after access has started in accordance with Section 02.

Refunds, credits, or goodwill extensions may be issued at the discretion of Sweatproof leadership or management. Any discretionary refund does not create an obligation to provide future refunds in the same or similar circumstances.

We may refuse, cancel, suspend, or reverse a transaction where we reasonably believe there is fraud, abuse, chargeback misuse, unauthorised payment activity, or a breach of these terms.

04. Licence and permitted use

Subject to your continued compliance with these terms and payment of any applicable subscription fees, we grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the service for your own permitted use only.

You must not sell, share, rent, sublicense, resell, transfer, leak, distribute, or provide access to the software, bot, account, licence key, token, subscription, or related materials unless we have given you written permission.

You are responsible for keeping your account, Discord account, licence details, and authentication information secure. Activity carried out through your account may be treated as your activity.

05. Prohibited conduct

You must not attempt to crack, bypass, disable, tamper with, reverse engineer, decompile, disassemble, copy, modify, exploit, scrape, clone, or interfere with the software, bot, website, licence checks, authentication systems, payment systems, anti-abuse systems, or any related infrastructure.

You must not attempt to gain unauthorised access to accounts, systems, servers, source code, APIs, private channels, payment records, bot commands, logs, or user data.

You must not use the service in a way that causes or attempts to cause downtime, degraded performance, spam, abuse, rate-limit bypassing, denial-of-service, security issues, or disruption to other users.

You must not use the service for unlawful activity, harassment, fraud, malicious automation, payment abuse, or any conduct that may harm Sweatproof, our users, our infrastructure, Stripe, Discord, or any third party.

06. Suspension, removal, and termination

We may suspend, restrict, remove, or terminate your access to the service if you breach these terms, misuse the service, create risk for us or others, fail to pay, abuse support, initiate fraudulent disputes, or where we reasonably consider removal necessary to protect the service, our community, or our legal interests.

Where lawful, we may also refuse service or remove access at our discretion. We will not use this discretion in a way that removes any non-excludable statutory rights you have under UK law.

If your access is removed for breach, abuse, fraud, chargeback misuse, or prohibited conduct, you may lose access to your subscription without refund unless a refund is required by law or expressly approved by management.

07. Service availability and SLA credit

We aim to keep the service available, but we do not guarantee uninterrupted or error-free access. Planned maintenance, emergency maintenance, third-party outages, Discord issues, Stripe issues, hosting issues, user-side setup problems, network issues, and force majeure events may affect availability.

For qualifying Sweatproof-controlled service downtime, you must allow up to 24 hours for investigation, mitigation, and restoration before any service credit applies.

After the first 24 continuous hours of qualifying Sweatproof-controlled downtime, we will add 1 day globally to affected active subscriptions for every additional full hour of qualifying downtime, unless leadership reasonably decides to provide a greater credit.

This SLA credit is the exclusive service credit for downtime and applies only to active subscriptions affected by the qualifying downtime. It does not apply to downtime caused by your own device, internet connection, Discord account, payment status, breach of terms, third-party platforms, or events outside our reasonable control.

08. Updates, changes, and beta features

We may update, patch, modify, suspend, rename, replace, or discontinue parts of the service to improve performance, security, compliance, or user experience.

Some features may be experimental, limited, or in beta. Beta features may change or be removed without notice and may not work perfectly.

09. Privacy and data we collect

We collect and process only the information we reasonably need to provide, secure, manage, and improve the service. This may include your Discord user ID, Discord username, linked identifiers, subscription status, plan details, licence status, bot usage, command usage, timestamps, support interactions, acceptance of these terms, security logs, and payment or billing metadata received from Stripe.

We use Stripe to process payments. We do not aim to store full card numbers on our own systems. Stripe may process payment details in accordance with its own terms and privacy notices.

We may use your information to provide access, verify subscriptions, prevent fraud and abuse, investigate breaches, provide support, maintain records, comply with legal obligations, and enforce these terms.

10. UK GDPR and data protection

We process personal data in accordance with applicable UK data protection law, including the UK GDPR and the Data Protection Act 2018 where they apply.

Our lawful bases may include performance of a contract, legitimate interests such as security and fraud prevention, compliance with legal obligations, and consent where consent is required.

You may have rights to request access, correction, deletion, restriction, portability, objection, or withdrawal of consent where applicable. These rights may be subject to legal limits, identity verification, security requirements, and retention obligations.

We keep personal data only for as long as reasonably necessary for the purposes described in these terms, including providing the service, maintaining security, resolving disputes, meeting accounting or legal obligations, and enforcing our rights.

11. Sharing information

We may share limited information with service providers that help us run the service, including payment processors, hosting providers, analytics or logging tools, Discord-related integrations, and support or security tools.

We may also share information where required by law, to protect our legal rights, to investigate abuse or fraud, to respond to lawful requests, or in connection with a business transfer such as a merger, sale, or restructuring.

We do not sell your personal information.

12. Limitation of liability

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any statutory rights that cannot be excluded under UK law.

To the fullest extent permitted by law, the service is provided on an as-is and as-available basis. We are not liable for indirect loss, loss of profits, loss of revenue, loss of goodwill, loss of data, business interruption, third-party platform issues, or losses caused by your misuse of the service.

Our total liability to you for claims relating to the service is limited to the amount you paid to us for the affected subscription period, unless a higher limit is required by law.

13. Changes to these terms

We may update these terms from time to time. The updated version will apply from the date shown on this page or from the date we otherwise notify you.

If a change materially affects your rights or obligations, we will take reasonable steps to make the update clear. Continued use of the service after changes take effect means you accept the updated terms.

14. Governing law

These terms are governed by the laws of England and Wales, unless mandatory consumer laws in another part of the UK apply to you and cannot be excluded.

Disputes will be handled by the courts of England and Wales, except where applicable consumer law gives you the right to bring proceedings elsewhere in the UK.
